Purpose of the service
To make available to the user company a tool to record and review information about vehicles and machinery, periodic checks, maintenance, incidents and associated documentation.
Registration and accounts
Access is granted through credentials provided by Flotary. The company is responsible for the custody and confidentiality of its credentials.
Plans and pricing
The service is contracted through plans with a maximum asset limit. Current prices are communicated on the platform itself prior to contracting.
Obligations of the user company
The company warrants that the information it enters is truthful and up to date; it undertakes to make lawful use of the service and to inform its drivers/operators.
Drivers and operators
Drivers or operators interact with the platform solely through per-vehicle public links. They do not require an account or any data processing beyond what is strictly necessary to record the check.
Data entered by users
The company is responsible for the data it enters and for having, where applicable, the appropriate legal basis to do so.
Service availability
Flotary will make reasonable efforts to keep the service operational, without guaranteeing uninterrupted availability.
Security
Technical and organisational measures are applied for the protection of information: HttpOnly cookie-based authentication, per-company isolation, in-transit encryption and access control.
Intellectual property
The software, brand and documentation belong to Flotary. The company retains ownership of the data it enters.
Term and cancellation
The service is provided for the duration of the contracted plan. Either party may terminate the agreement in accordance with the terms of the plan itself.
Data deletion and export
The company may request the export of its operational data and its subsequent deletion. A default recovery period of 30 days applies from the deletion request.
Disclaimer relating to vehicles and machinery
Flotary is an administrative management and tracking tool. It does not replace the roadworthiness test (ITV), technical inspections, mandatory maintenance, safety reviews, manufacturer recommendations or the company's legal obligations, nor the professional assessment of a mechanic/technician. The company remains responsible for the accuracy of the data entered, the maintenance and safety of its assets and compliance with inspections and due dates. Alerts, statuses and reminders are supporting tools.
Limitation of liability
To the extent permitted by applicable law, Flotary's total liability is limited to the amount actually paid by the company during the twelve months preceding the triggering event.
Governing law and jurisdiction
These terms are governed by Spanish law. In relations with consumers and users, the courts and tribunals designated by applicable regulations shall have jurisdiction. In all other cases, legally applicable rules of jurisdiction shall apply.
Amendment of terms
Flotary may update these terms. When a material change occurs, new acceptance will be requested before continuing to use the service.
